Real Estate Transactions
The Law Office of Thomas Howard represents both buyers and sellers in residential and commercial real estate transactions in Park City and Salt Lake City, as well as throughout Summit and Wasatch counties in Utah.
When representing buyers or sellers, Thomas Howard works to resolve potential problems prior to closing, such as:
- Title issues
- Boundary disputes
- Adverse possession
- Subsurface rights
In Utah, a general real estate purchase contract (REPC) is most often prepared by a real estate agent. Thomas Howard will write custom contracts protecting specific concerns of the buyer or seller and review the REPC and add contingency clauses that protect the client’s interests in these contracts.
Real Estate Litigation
Thomas Howard uses both his negotiation skills and his litigation experience to represent property owners in real estate disputes over:
- Property lines (also called lot lines)
- Fence lines
- Condominium rules
- Homeowner Association rules
- Real Estate Purchase Agreements (both enforcing and breaking)
- Land use
Representing Real Estate Agents and Brokers
Thomas Howard represents real estate brokers and agents in disciplinary actions taken against them by regulatory and governing bodies such as the Utah Division of Real Estate, the Board of Realtors, and the Utah Association of Realtors (UAR). These bodies have the power to impose heavy fines on real estate brokers and agents and also to take away real estate licenses. Thomas Howard represents agents and brokers before these bodies in informal dealings, in formal hearings, and in appeals.
